By accessing YathraFin's website and using the resources, information, services, products, and tools we provide, you agree to accept and adhere to the following terms and conditions (referred to as the "User Agreement"), along with the terms outlined in our Privacy Policy.

Updates to the User Agreement

YathraFin reserves the right to modify this User Agreement periodically without prior notice. You acknowledge it is your responsibility to review this Agreement regularly. Your continued use of the site following changes constitutes acknowledgment and acceptance of any modifications.

Responsible Use and Conduct

Abuse Policy

YathraFin maintains a zero-tolerance policy for abusive behavior. If a client abuses YathraFin employees through chat, calls, or any other means, YathraFin reserves the right to cancel services for that client. Any refund will be issued per the refund policy, and the client’s portal access will be permanently blocked. Legal action may be pursued depending on the severity of the abuse.

Privacy

Our separate Privacy Policy details how we collect, manage, process, secure, and store your private information. The Privacy Policy is included under the scope of this User Agreement.

Limitation of Warranties

By using our website, you acknowledge that all resources are provided "as is" and "as available." YathraFin does not guarantee that our resources will meet your requirements, be uninterrupted, or be free of errors.

Limitation of Liability

YathraFin is not liable for any direct, indirect, incidental, or consequential loss or damages resulting from your use of our resources. Any claims against us are limited to the amount you paid, if any, for using our services.

Intellectual Property

All content on YathraFin’s website, including text, graphics, code, and logos, is the intellectual property of YathraFin Private Limited, protected by applicable copyright and trademark laws. Unauthorized use, reproduction, or transmission of any content is prohibited unless expressly authorized by YathraFin.

Termination of Use

YathraFin reserves the right to suspend or terminate your access to our website and resources at its discretion, with or without notice, for any breach of this Agreement. Suspected illegal or abusive activity may result in termination and referral to law enforcement. Upon suspension or termination, your right to use our resources ceases immediately, and we may delete any information associated with your account.

Governing Law

This User Agreement is governed by the laws of Tamil Nadu, India. By accessing our website, you agree to submit to the jurisdiction of the courts in Tamil Nadu for any disputes related to this User Agreement.

Cancellation and Refund Policy

Once payment is completed, cancellations are generally not possible. Refunds will be issued only in cases of cancellation or non-performance of services by YathraFin. Specific details of our refund policy are available upon request.

Warranty Disclaimer

Unless otherwise stated, YathraFin disclaims all warranties and conditions, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

Service-Specific Terms for Incorporation, Startup, and Registration Services

• Bank Details Sharing: If required, YathraFin may share your name, phone number, and email with a bank of your choice, with your consent. Approval of bank accounts is subject to the bank's discretion.
• Partnership Registration: Additional charges for registration with the Registrar of Firms may apply.
• Name Approval Requests: YathraFin allows up to four name options per RUN request.
• Authorized Capital: The initial authorized capital can be increased as needed.
• Paid-Up Capital: This represents the actual investment by shareholders.
• Statutory Auditor Fees: Fees are payable directly to the Independent Auditor appointed by the Board.
• Independent Statutory Auditor: All companies must appoint one within 30 days of incorporation.
• Digital Signature Certificates (DSC): YathraFin provides DSC tokens and KYC support, but payments for certificates are made directly to the certifying authority.
• Stamp Duty: Clients are responsible for stamp duty fees, which vary by state.
• Application Irreversibility: Once MCA payment is made, the application is non-refundable and cannot be recalled. In cases of document rejection, a refiling fee of ₹1,999 applies.
• Third-party fees: Beyond the service fee, these are the client's responsibility.

Disclaimer on Government Approvals

YathraFin provides assistance with applications for MCA name approvals, trademarks, copyrights, and patents. However, these approvals are subject to government rules and policies, and final decisions rest solely with the respective authorities. YathraFin does not guarantee or assure any approval outcome, as these decisions are beyond our control. Clients are responsible for ensuring the accuracy and completeness of all information provided, and YathraFin will offer guidance only on the application process and general best practices.
